Quarantena in WA e diritti del consumatore - Hotel Quarantine in WA and consumer rights

Sono quasi alla fine del periodo di quarantena e se il tampone che mi faranno oggi risultera' negativo potro' finalmente uscire da questa camera che mi ha visto in cattivita' e mi ha fatto pure divenatare "cattivo". Dico cattivo perche' giorno dopo giorno mi e' sembrato sempre piu' evidente come questo confinamento oltre ad avermi privato della mia liberta', mi ha privato anche dei piu' basilari diritti.

Vi ho accennato in precedenza in merito alle difficolta' che ho riscontrato in merito all'impianto di condizionamento della mia stanza che mi ha visto dover tollerare una temperatura di 35C per quasi 3 giorni (2 notti) prima che venisse finalmente sistemato. Ma vi ho anche descritto l'episodio e l'umiliazione che ha coninvolto mia moglie quando mi ha lasciato dell'attrezzatura sportiva per poter tenere impiegato il mio tempo durante questa quarantena.

Ovviamente ho sottomesso formale lamentela di questi fatti direttamente all'hotel con una email nella quale chiedevo esplicitamente una compensazione per il danno subito tramite rinegoziazione della fattura finale per la mia permanenza. A tale email mi e' stato risposto solo tramite telefono con una conversazione informale. Mi e' stato detto che l'hotel non ha alcun potere di poter rinegoziare il pagamento della quarantena e che gli ospiti come me sono direttamente gestiti dal dipartimento della salute del mio stato. Mi e' stato detto che la mia comunicazione era stata inoltrata a loro.

Non contento ho preso l'iniziativa di contattare il dipartimento di mia sponte. Dapprima tramite telefono utilizzando la line adedicata alle informazioni sul Covid che lo stato ha messo a disposizione. Le mie domande erano praticamente due:

1) Ho gli stessi diritti di un normale consumatore oppure essendo in quarantena questi diritti mi sono privati?
2) A chi devo fare richiesta per eventuali compensazioni relative al pessimo servizio ottenuto dall'albergo?

Nessuno sapeva rispondere alle mie domande abbastanza semplici e sono stato rimbalzato da ufficio ad ufficio. Alla fine mi viene dato un indirizzo email a cui indirizzare le mie domande.

Prontamente mando l'email e faccio presente il mio problema. Ottengo una risposta in tempi decisamente rapidi (qualche ora piu' tardi) in cui mi viene detto che la riduzione del costo della quarantena non e' possibile se non per comprovate ragioni di difficolta economica, cosa che non e' il mio caso. Vengo comunque invitato a lasciare un feedback al dipartimento.

Stamattina accade qualcosa che ha dell'incredibile, ricevo assieme alla colazione una lettera del dipartimento della salute di tipo standard dove mi si dice che la mia quarantena si sta per concludere e mi invitavano nbuovamente a lasciare un feedback fornendomi un link dedicato. Attendevo questo link con fervida trepidazione per poter lasciare il mio commento.

Di seguito vi faccio vedere come e' stato strutturato il modulo da riempire. Guardate bene le immagini. Se qualcuno si sta domandando dove sia il resto, ebbene e' tutto qui. I am almost at the end of the quarantine period and if the swab that I will have today is negative I will finally be able to get out of this room that saw me in captivity and made me even become "bad". I say bad because day after day it seemed more and more evident how this confinement, in addition to depriving me of my freedom, also deprived me of the most basic rights. 

I mentioned earlier about the difficulties I encountered with the air conditioning system in my room which saw me having to tolerate a temperature of 35C for almost 3 days (2 nights) before it was finally sorted out. But I have also described the episode and the humiliation that my wife had to experience when she left me some sports equipment.

Obviously I submitted a formal complaint of these facts directly to the hotel with an email asking for compensation for the damage suffered. This email was only answered by phone with an informal conversation. I was told that the hotel has no power to renegotiate the quarantine fees and that guests like myself are handled directly by the Department of Health of WA. I was told my communication had been forwarded to them.

Not happy, I took the initiative to contact the department on my own. First by telephone using the line dedicated to information on Covid that the state has made available to anyone. I wanted to ask two simple questions: 

1) Do I have the same rights as a normal consumer or are these rights deprived of me being in quarantine?

2) Who should I apply to for any compensation related to the bad service obtained by the hotel?

No one could answer my fairly simple questions and I was bounced from one office to another. Eventually I am given an email address to which I could direct my questions. I promptly sent the email and reported my problems during the quarantine.

I got an answer very quickly in which I am told that the exemption or reduction of the cost of quarantine is not possible. The fees may be waived only in circumstances of financial hardship, which is not my case. However, I am invited to leave feedback to the department.

It is clear to me that the answer to my first question is that I lost any consumer right. I replied to the email asking to elaborate more what they meant with the sentence: "the quarantine fee is fixed and cannot be varied" written in the email I received from them. I want to know why, in circumstances like mine, guests, who had to suffer from poor service from the hotel, cannot exercise their consumer rights.

This morning I received, along with breakfast, a pretty standard and impersonal letter from the health department where they tell me that my quarantine is about to end and they invited me again to leave feedback by providing me a dedicated link.

I was waiting for this link with fervent trepidation to be able to leave my comment. Above I show you how the form to fill in was structured. Take a good look at the images.
